TERMS AND CONDITIONS
These conditions of sale concern the purchase of products and services made through the website www.3sixtyshop.it, with registered office in Via Cinque Giornate 38 22100 Como with VAT number 03222130134.
1.THE CONTRACT
There is no commitment between you and 3SIXTYSHOP until 3SIXTYSHOP has sent you an e-mail confirming receipt of the order and its acceptance. 3SIXTYSHOP has the right to withdraw from any commitment in the event of obvious errors or inaccuracies concerning the goods or orders appearing on the 3SIXTYSHOP website.
2.PRICES AND AVAILABILITY
The prices of 3SIXTYSHOP products are clearly indicated on the site and are inclusive of VAT. The shipping cost must be added to the product price, the amount of which varies according to the quantity and weight of the total order, as well as the delivery method. The data relating to price and availability shown on the 3SIXTYSHOP website are subject to change without notice, but the price indicated at the time of the order is valid for payment.
3. DELIVERY OF PRODUCTS
3SIXTYSHOP will deliver the ordered products to the address you indicated in the registration (unless requested in the notes at the time of order confirmation). All delivery times shown on 3SIXTYSHOP are estimates based solely on normal order processing and delivery times declared by carriers. The couriers used do not make preventive phone calls nor do they manage requests for shipments at particular times. Indicatively, without this entailing any obligation for 3SIXTYSHOP and barring any cases of force majeure, the goods will be delivered by 3SIXTYSHOP to the courier within 24/48 hours (working days).
4. CUSTOMS DUTIES
For all shipments originating or directed to and from countries that do not belong to the European Union, customs duties are charged to the recipient and never included in the cost of the shipment.
If the recipient refuses to pay the customs duties, these will be charged to the orderer of the shipment or, if the Customs allows it, ask the courier to return the shipment to the sender.
If the purchaser decides to return the shipment to the sender, he will have to pay the costs of returning the goods and also the import customs duties in the country of origin.
5.LIABILITY
3SIXTYSHOP assumes no responsibility for disservices attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevented, in whole or in part, the delivery of the shipment on time agreed by the contract. 3SIXTYSHOP will not be liable to any party for damages, losses and costs incurred as a result of the non-execution of the contract (for the reasons mentioned above), the consumer having the right only to a refund of the price paid. Likewise, 3SIXTYSHOP is not responsible for any fraudulent or illegal use by third parties of checks and other means of payment when paying for the purchased products.
6.RIGHT OF WITHDRAWAL
The customer has the right to withdraw, without any penalty, within and no later than 14 working days from delivery. Subjects that cannot be classified as consumers are excluded from the legislative decree, i.e. those who act for purposes related to any professional activity carried out, i.e. those who place an order indicating the VAT number for the invoice. The right of withdrawal is exercised within the established deadline, upon request for authorization to the e-mail address info@3sixtyshop.it. Exchanges or returns of clothing (including accessories) are permitted if the products are faulty or not the size ordered. In these cases, the service is free and the shipping costs for the return and any size exchange are always charged to 3SIXTYSHOP. The products must reach us intact, not worn or stained, they must be in the original packaging, complete with labels and any other part that composes them. Failure to comply with these principles renders the right of withdrawal inapplicable. We invite our kind customers to collaborate with us by following our procedure for sending returns and not to send us goods for which the right of withdrawal is not applicable. Once the goods have been received, 3SIXTYSHOP will arrange for the size change or the refund of the entire amount paid by the customer, excluding shipping costs, directly to the credit card used for payment, via the PayPal platform. Attention: in the event that the right of withdrawal is not applicable, the products will be returned to the sender with shipping paid by the customer.
7. PURCHASER'S OBLIGATIONS
The consumer undertakes and obliges, once the "online" purchase procedure has been concluded, to print and keep these general conditions, which, however, he will have already viewed and accepted at the time of registration. 6.1 These general conditions may be updated or modified at any time by 3SIXTYSHOP, which will communicate it on the homepage of the site and by e-mail. The consumer undertakes and undertakes, whenever a modification of these general conditions occurs, to provide for their printing and conservation. 6.2 The purchaser is strictly prohibited from entering false, and/or invented, and/or fictitious data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and e-mail must be exclusively one's real personal data and not of third parties, or of fantasy. It is expressly forbidden to make double registrations corresponding to a single person or enter data of third parties. 3SIXTYSHOP reserves the right to legally prosecute any violation and abuse, in the interest and for the protection of all consumers. 6.3 The customer raises 3SIXTYSHOP from any liability deriving from the issue of incorrect tax documents due to errors relating to the data provided by the customer, being the customer himself solely responsible for the correct insertion.
CURRENT LEGISLATION AND JURISDICTION
The contracts between you and 3SIXTYSHOP will be subject to Italian legislation and all disputes will be the responsibility of the Court of Como.
